Terms and Conditions of Use

These Terms and Conditions of Use ("Terms and Conditions") sets out the terms of use of services provided through the Coke ON smartphone app run by Coca-Cola (Japan) Company, Ltd. User must agree to these Terms and Conditions of Use before using the App.

Article 1 - Definitions

The terms used in these Terms and Conditions of Use shall have the meanings as defined below.

The Company
Coca-Cola (Japan) Company, Ltd.
The App
The Coke ON smartphone app run by the Company, Ltd.
The Services
Various services provided to users through Coke ON
User
A person who uses the App
Registered Information
Any information provided by Users to the Company to use the App
Termination of Use of the App
Termination of the use of Coke ON by deletion of Registered Information as provided by these Terms and Condition of Use or as provided otherwise by the Company
Smartphone
Vending Machine
A vending machine that provides services linked to Coke ON
Smartphone
Vending Machine Services
Various services provided by Smartphone Vending Machines using Coke ON
Stamp
An electronic stamp that can be collected through the purchase of a drink using a Smartphone Vending Machine Service, or by using the Services.
Stamp Card
An electronic stamp card that lists collected stamps in Coke ON
Drink Ticket
A ticket that can be redeemed for one drink using a Smartphone Vending Machine. Users can receive Drink Tickets in Coke ON by meeting a set of conditions
Trial Drink Ticket
A ticket that can be redeemed for one drink of a particular kind using a Smartphone Vending Machine. Users can receive Trial Drink Tickets in Coke ON through a limited-time campaign etc.
App ID
An ID required to transfer data from a previous user environment when changing phones or re-installing the App
PIN
Authentication information required to transfer data from a previous user environment when changing phones or re-installing the App
Coupon Code
A string of characters that can be used to collect Trial Drink Ticket(s) or Stamp(s) of a particular kind by completing a form in "Coke ON." Coupon Codes are issued by the Company, and distributed and sold by the Company or through a third party such as an e-gift service provider
Coke ON Walk
A pedometer-linked service that can be used by linking pedometer data on the User's smartphone in Coke ON
Coke ON Pay
A payment service that allows Users to pre-register a preferred payment option such as credit card through the App to make a payment using the registered payment option when purchasing a product from a Coke ON Pay-supported Smartphone Vending Machine
Coke ON IC
A service that Users can pre-register to use with information such as their e-money details through the App to receive stamps issued for the purchase of products from Coke ON IC-supported vending machines using the registered e-money
Coke ON
IC-supported Vending Machine
A vending machine that provides services using Coke ON IC
Coke ON Code Reader
A code reader that can be used in the Coke ON app. By scanning the barcode or 2D code on the package of the target products with the Coke ON Code Reader, Users can access the campaign website and participate in the campaign.
Coke ON Pass
Coke ON Pass is a subscription service that allows you to purchase specific Coca-Cola products at a specified quantity and on specified days at Coke ON Pay-supported Vending Machine by paying a fixed rate in advance every month.
Restricted function App
An application that restricts the use of some services from this application. Unless otherwise specified in these terms and conditions, the terms and conditions for this application shall apply.
Coke ON drink ticket bundle sales service.
This is a bundle service that allows you to purchase multiple "Coke ON Drink Tickets" only within the app." The service can be used at Coke ON Pay-supported Smartphone Vending Machine.
Coke ON Wallet
A payment and point service for Coke ON authorized by the Company. It can be used to purchase Coca-Cola products at Smartphone Vending Machines that accept "Coke ON Pay" as a payment method.
Coke ON Money
A prepaid service that allows users to load a certain amount of money into their Coke ON Wallet from a bank account, vending machine or other means designated by the company, which can then be used to purchase Coca-Cola products from the Smartphone Vending Machine
Coke ON Point
Points earned through campaigns can be used to purchase Coca-Cola products from the Smartphone Vending Machine through the Coke ON Wallet.
Coke ON Wallet balance
The total balance of Coke ON Money and Coke ON Point

Article 2 - Purpose

  1. The Terms and Conditions stipulate the terms and conditions for using the App. Users shall use this App in accordance with the conditions set forth in the Terms and Conditions.
  2. By agreeing to the Terms and Conditions, an agreement for using the App ("Agreement") is entered into between the User and the Company, with the Terms and Conditions as the contractual terms and conditions.
  3. Persons under the age of 13 (12 years old or younger) are not allowed to use the App.

Article 3 - Changing Devices for Use

In cases where Users change smartphones, they may continue to use information in relation to the App/Services and the various rights by following the procedure as provided by the Company.

Article 4 - Logging In

  1. When using this App, Users of the App may log in with an account for services run by the Company other than the App's Services, or run by other companies (hereinafter collectively referred to as "External Services"). By logging in with the same account, Users can transfer user environment data such as Stamps and Drink Tickets to another smartphone in case of re-installation of the App or changing mobile phone. In addition, you can get "Coke ON Points" once you login to the app and participate in various campaigns. However, usage environment data in the Restricted function App can only be transferred to the restricted function App in other devices. Usage environment data in the full version app can only be transferred to the full version App in other devices. Only one device can be used at the same time while logged into this App, and the user environment data of the original device will be reset when logging into a new device.
  2. Users of the App may perform log-in procedures with an account for External Services by following steps prescribed by the Company. Users may only log in with an account for External Services if they accept that their personal information registered with the operators of External Services (hereinafter referred to as "External Service Information") may be stored in the system for the Services and displayed in the Services after completing the log-in procedures.
  3. The purpose of use and other items regarding the handling of External Service Information stored in the system for the Services shall be as defined in a separate Privacy Policy prepared by the Company.

Article 5 - Responsibility to Manage Authentication Information

It is the User's own responsibility to manage their authentication information (App ID and PIN) for the App.

Article 6 - Termination of Use

  1. Users may terminate their use of the App and the Services at any time as provided by these Terms and Conditions of Use or as provided otherwise by the Company. The Agreement will be terminated upon termination of use of the App. If the Agreement is terminated, your registered information will be deleted, and you will no longer be able to use the App or the Services. In this case, the registered information cannot be restored.
  2. The Company may, at its discretion, terminate the Agreement and a User's right of use immediately without any notification or demand if any of the following applies to Users, or is deemed by the Company to apply to Users on reasonable grounds:
    1. Users have violated these Terms and Conditions of Use
    2. Users registered information includes untrue or incorrect information
    3. Users' registered authentication information is deemed to be not working
    4. Users used someone else's identity when registering as a User
    5. Users have committed any of the prohibitions provided in Article 10
    6. Users have otherwise been deemed by the Company to be inappropriate as a User
  3. The Company shall not be obligated to disclose the reason for termination of the User's right of use under the Clause 2 of this Article 6 to them.

Article 7 - The Services

  1. Users may receive the Services through the App.
  2. The Company delivers information deemed to be beneficial to Users who have registered as recipients and other notifications from the Company, etc. by push notification via the App.
  3. Users may receive the services defined in this Article free of charge (except as otherwise provided in these Terms and Conditions or the App). However, any communication costs for smartphones etc. used to receive the services shall be borne by the User.
  4. The Company may provide Users with additional services other than the services defined in this Article.
  5. The Company may change all or part of the contents or specifications of the Services for any reason without giving the User any notification. However, if the Services are suspended or discontinued, Users will be given a prior notification by a method deemed by the Company to be appropriate, or informed via the App or a website regarding the Services etc.
  6. In the Restricted function version of the App, services are limited to (1) and (6). Additional available services will be announced within the restricted function App.
    1. Stamp Card
      1. Users may receive Stamps when purchasing drinks from Smartphone Vending Machines, or using the App/Services.
      2. Collected Stamps may be viewed on a Stamp Card on the App. When 15 Stamps are collected, a new Stamp Card may be obtained.
      3. A Stamp Card expires 365 days after the first Stamp is affixed on the Stamp Card. If 15 Stamps are not collected by the expiration date, any collected Stamps will expire.
      4. More than one Stamp may be obtained under certain conditions. Conditions such as the period and target products will be communicated within the App.
      5. The User's communication environment may delay the issue of Stamps after drinks are purchased from Smartphone Vending Machines. In a good communication environment at the time of use, a Stamp may be obtained within a few minutes of purchasing a drink. When purchasing a drink from Coke ON IC-supported vending machine, a Stamp may be obtained within a few days.
      6. If a Smartphone Vending Machine Service cannot be used properly and the User cannot connect to the Smartphone Vending Machine, a Stamp cannot be obtained at the time of purchasing a drink.
      7. The mechanical condition of a Smartphone Vending Machine or Coke ON IC-supported vending machine may prevent stamps from being issued.
      8. Stamps may not be issued at a later date in any circumstances.
    2. Drink Tickets
      1. User can obtain one Drink Ticket by collecting 15 Stamps.
      2. User may use the App/Services to redeem a Drink Ticket for one product of the User's choice loaded in a Smartphone Vending Machine.
      3. Drink Tickets expire 90 days after obtaining them. Expired Drink Tickets will be erased.
      4. User's communication environment may delay the issuing of Drink Tickets. In a good communication environment at the time of use, a Drink Ticket may be obtained within a few minutes after meeting certain conditions.
      5. Drink Tickets may not be transferred to a third party unless otherwise stated in the App.
      6. The conditions of the Smartphone Vending Machine's equipment, communication line, etc. may prevent the issue of Drink Tickets.
    3. Trial Drink Tickets
      1. The Company may distribute Trial Drink Tickets that can be redeemed for one product of a certain kind as part of a limited-time campaign. Details such as the period of such campaigns and target products will be communicated within the App.
      2. The log-in procedures defined in Article 4 are required to obtain/use Trial Drink Tickets.
      3. A Trial Drink Ticket may be redeemed for one of the campaign's target products loaded in a Smartphone Vending Machine using the App/Services.
      4. Trial Drink Tickets are valid until expiration dates specified by each campaign. Expiration dates will be communicated within the Trial Drink Tickets. Expired Drink Tickets will be erased.
      5. Trial Drink Tickets may not be transferred to a third party unless otherwise stated in the App.
      6. The conditions of the Smartphone Vending Machine's equipment, communication line, etc. may prevent the use of Trial Drink Tickets.
    4. Coupon Codes
      1. The Company may issue, and distribute directly or through a third party, Coupon Codes which can be exchanged for one Trial Drink Ticket or other benefits (including points to participate in campaigns) of a prescribed kind by completing a prescribed form within the App.
      2. The expiry date and target products for Trial Drink Tickets or details for other benefits which can be obtained by entering Coupon Codes may be referred to when each Coupon Code is distributed or in the screen within the App.
      3. Coupon Codes must be entered before their expiry date. A Trial Drink Ticket or other benefits may not be obtained by entering an expired Coupon Code.
      4. A Coupon Code is a unique string of characters, and each Coupon Code can only be used once. A Trial Drink Ticket or other benefits may not be obtained by entering a used Coupon Code.
      5. The Company only issues a Trial Drink Ticket or other benefits to a User if they have entered a Coupon Code whose information has been confirmed to match that which has been issued by the Company. In a case where a third party unlawfully obtains and enters a Coupon Code against the will of a User, the Company shall not return, re-issue or otherwise recover the used Coupon Code.
    5. Coke ON Walk
      1. Users may use the Coke ON Walk service by linking pedometer data on their smartphones and setting a weekly target number of steps from the Coke ON Walk or App Setting screen.
      2. A weekly target number of steps may be selected from pre-defined choices; it is possible to change the selection, but a new target number of steps will not be reflected until the following Monday.
      3. Coke ON Walk allows Users to win Stamps every time they achieve a pre-set weekly target number of steps, or achieve a total target number of steps displayed in Coke ON Walk.
      4. Coke ON Walk may hold limited-time campaigns. Some campaigns will require "entry" for participation. Refer to each campaign page for details such as qualifications for participation, achievement criteria, and prizes for each campaign.
    6. Coke ON Pay
      1. The Coke ON Pay payment service allows Users to pre-register a preferred payment option such as credit card through this App to make a payment using the registered payment option when purchasing a product from a Coke ON Pay-supported Smartphone Vending Machine.
      2. Coke ON Pay users may use payment methods specified by the Company such as credit card, debit card, and pre-paid card (hereinafter "Credit Card etc."). Details of supported payment methods may be viewed within the App. Please note that supported payment methods are subject to change.
      3. In order to Payment Method Information such as credit card numbers etc. (hereinafter "Payment Method Information") with Coke ON Pay, Users need to first log into the App. Registrable Payment Method Information is limited to that which belongs to the User of the App themselves.
      4. Payment Method Information such as Credit Card etc. will be sent directly to a clearing house commissioned by the Company to manage Payment Method Information and clear payments (hereinafter "Clearing Houses"), and encoded to be recorded securely; it will only be used anonymously within the Company system for payment processing purposes.
      5. When registering Payment Method Information for the first time with Coke ON Pay, when changing phones, or re-installing the App, etc., the User's Credit Card etc. will need to be cross-checked with the issuing company following procedures provided by the Company; if the payment details are not approved, the Coke ON Pay payment service may not be used.
      6. Payments by Coke ON Pay may only be made by registered Users of the App themselves.
      7. When purchase is made by a registered User of Coke ON Pay, the Company will regard such use to have been made by the registered person themselves. In a case where a third party unlawfully obtains and uses a User's smartphone against their will, the Company shall not make a refund or otherwise compensate for it. With regard to the relationship between Users and their credit card companies in transactions, Users are asked to please refer to the respective issuing companies of their credit cards etc.
      8. Unless otherwise specified on this App, payment method information registered with Coke ON Pay may be changed or deleted from within this App. However, changing/deleting Payment Method Information will not affect any debts and credits already incurred at the time.
      9. The Company may place restrictions on Users who can register with Coke ON Pay depending on the extent to which Coke ON Pay-supported Smartphone Vending Machines are installed, and other circumstances including the progress of promotions.
    7. Coke ON IC
      1. "Coke ON IC" allows Users to pre-register their e-money details through this App, and then to receive stamps issued for the purchase of drinks from Coke ON IC-supported vending machines at a later date.
      2. One of e-money services specified by the Company needs to be used. Details of supported e-money services may be viewed within the App. Please note that supported e-money services are subject to change.
      3. Coke ON IC-supported vending machines are limited to vending machines specified by the Company. Details of supported Coke ON IC vending machines may be viewed within the App.
      4. In order to register information such as e-money numbers etc. (hereinafter "E-money Registration Information"), Users need to first log into the App. Registrable e-money information is limited to that which belongs to, and is used by the User of the App themselves.
      5. When e-money registered with Coke ON IC is used, the Company will regard such use to have been made by the registered person themselves, and issue Stamps accordingly. In a case where a third party unlawfully obtains, registers or uses a User's e-money against their will, the Company shall not replace their Stamps or otherwise compensate for them. With regard to the relationship between Users and their e-money companies, Users are asked to check with their own e-money companies.
      6. E-money Registration Information is securely encoded before being recorded, and used anonymously for Stamp issuing purposes.
      7. Some Users may not be allowed to participate in promotions targeted at Smartphone Vending Machine Services. Please check details in the App.
      8. No Stamps will be issued in any case if drinks are purchased from undesignated vending machines or with unregistered e-money.
    8. Coke ON Code Reader
      1. Users can access the campaign website and participate in the campaign by scanning the barcode or 2D code on the packages of the target products etc. using Coke ON Code Reader.
      2. To use Coke ON Code Reader, permission must be given to allow access to the smartphone's camera.
      3. Please note that the Coke ON Code Reader service may fail to start properly depending on the User's smartphone model or its specs (e.g. an old model).
      4. Users shall use the Coke ON Code Reader service with due care for the safety of their surroundings. Please do not use it while driving, walking, in dangerous places, etc.
    9. Coke ON Pass
      1. By paying a fixed rate in advance every month, users can purchase a specified quantity of specific products on specified days at Coke ON Pay-supported Vending Machine. The number of Coca-Cola products that can be purchased from Coke ON Pay-supported Vending Machines depends on the plan you sign up for. You can check the plans, prices, application dates, and other specification details on the App.
      2. The plans, prices, and other specifications are subject to change or termination without notice.
      3. Users over the age of 18 who have downloaded this App to their smartphone in advance and logged in as stipulated in Article 4 can sign up for the "Coke ON Pass" plan.
      4. The use of Coke ON Pass is restricted to users who have signed up for the Coke ON Pass plan themselves. Use of a single Coke ON Pass by multiple users is prohibited.
      5. To sign up for a Coke ON Pass plan, you can use our specified payment methods. You can check the details of compatible payment methods on this app. Please note that the compatible payment methods are subject to change.
      6. The price of the plan is as shown on this app. If you sign up for Coke ON Pass after the 23rd of the month, the payment for this period will be added on top of the "Monthly Plan Fee" for the amount charged the following month. Unless you apply to suspend your plan as described in Item 9 of this section, your contract will be automatically extended every month. From the month after signing up, the "Monthly Plan Fee" will be charged on the first day of each month, and the same will apply thereafter (with the exception of Apple Pay). You can check your billing history on the App.
      7. You can purchase Coca-Cola products at Coke ON Pay-supported Vending Machine immediately after you have successfully paid the monthly plan fee. You can check your usage history on the App.
      8. Although you typically will not get stamps when you purchase products by Coke ON Pass, you may get stamps during promotions for a limited time only. Please check the information on the promotion page on this app.
      9. The usage period shall be one month, and unless you apply to suspend your plan as specified in this section, the usage period shall be automatically renewed for a further month, and the same shall apply thereafter. Applications to suspend your plan shall be made from the Coke ON Pass app. Usage for the following month can be suspended by making an application between the 1st of the month up to 14:59 on the last day of each month. You cannot apply to suspend your Coke ON Pass plan from 15:00 to 23:59 on the last day of the usage period. No cancellation fees or penalties will be incurred for suspension of use based on this section. We cannot accept any means of suspending or canceling your Coke ON Pass plan other than the method outlined above.
      10. The payment method information set for payment of your Coke ON Pass plan can be changed or deleted on this app. However, any changes to or deleting of payment method information shall not affect the claims and liabilities that have already been incurred up to that point.
      11. If a Coca-Cola product is exchanged using the Coke ON Pass plan that you signed up for, it will be deemed that the pass has been used by the corresponding user and the vending machine will provide the chosen product. Even if a third party illegally obtains and uses the user's smartphone against the intention of the user, we shall not give refunds based on such use. For information regarding the history of usage between the user and the credit card company involved in the transaction, please check with the company that issued your credit card.
      12. If unauthorized use is suspected, we may take any measures that we deem necessary, such as suspending the Coke ON Pass plan and suspending the use of this service, without notifying the user.
      13. Please refer to the notice about the Act on Specified Commercial Transactions regarding Coke ON Pass within the App.
      14. Subscriptions to the Coke ON Pass may be limited based on the availability of Coke ON Pay -supported vending machines and other promotions.
    10. Coke ON drink ticket bundle sales service
      1. Users may purchase coupons of "Coke ON drink ticket bundle sales service" from the Coke ON app's sales page within this application.
      2. The coupons of "Coke ON drink ticket bundle sales service" can only be purchased by users over the age of 18 who have downloaded the application to their smartphones in advance and logged in as specified in Article 4.
      3. The coupon price, number of coupons available for purchase, products to be redeemed, expiration date, and other specifications of the "Coke ON drink ticket bundle sales service" that can be purchased shall be as stated on our sales page.
      4. The coupons of "Coke ON drink ticket bundle sales service" can be purchased using payment methods specified by us. The details of the payment methods are available in this application. Please note that the payment methods are subject to change.
      5. After the payment is completed, you can redeem the coupons at any Coke ON Pay-enabled vending machine. The number of remaining tickets and redemption history can be checked from within this application.
      6. The coupons of "Coke ON drink ticket bundle sales service" may only be used by the person who purchased them. Use by more than one person is prohibited.
      7. The expiration date of coupons for "Coke ON drink ticket bundle sales service" can be checked on our sales page and on the ticket screen after purchase. The coupons for "Coke ON drink ticket bundle sales service" will be invalid and deleted after the expiration date.
      8. No returns or cancellations will be accepted after purchase of coupons for "Coke ON drink ticket bundle sales service".
      9. The sale of "Coke ON drink ticket bundle sales service" is subject to change or termination without notice.
      10. No stamps will be given when redeeming "Coke ON drink ticket bundle sales service", but stamps may be given for time limited campaigns such as promotions. Please check the campaign page in this application for details.
      11. If unauthorized use is suspected, we may take any measures that we deem necessary, such as suspending the use of "Coke ON drink ticket bundle sales service" without notifying the user.
    11. Coke ON Wallet
      1. Coke ON Wallet is a payment and point service for Coke ON authorized by the Company. Coke ON Wallet is a "prepaid payment instrument for third party business" operated by Infcurion, Inc ("Infcurion").
      2. You can sign up to use "Coke ON Wallet" from the page in the App that is designated by the Company. When signing up, you are required to agree to the Coke ON Wallet Terms of Use provided by Infcurion, in addition to these Terms and Conditions.
      3. "Coke ON Wallet" contains two services: "Coke ON Money" and "Coke ON Points".
      4. "Coke ON Money" is a prepaid service that can be used by logging in to Coke ON and registering to use "Coke ON Wallet". You can charge the designated amount of money to your Coke ON Wallet from your bank account, a vending machine or other method designated by the Company. The charged amount can be used as the payment method designated by the Company. Coke ON Money is valid until the end of 36 months after the date of the last payment or charge with Coke ON Wallet. Once charged, Coke ON Money will not be refunded except provided in the Coke ON Wallet Terms of Use.
      5. "Coke ON Points" is a point that can be earned by logging into Coke ON and participating in campaigns designated by the Company. In principle, Coke ON Points expire at the end of 12 months after the day on which they were earned. However, any points that have a specific expiration date will expire after the specified period. Notwithstanding the foregoing, for the users who have not signed up to use "Coke ON Wallet", "Coke ON Points" expire at the end of the following month from the date on which the points were earned, and if such users successfully sign up to use "Coke ON Wallet" within the valid period of such points, the expiration date will be extended to the end of 12 months after the day on which they were earned.Coke ON Points will not be refunded except provided in the Coke ON Wallet Terms of Use.
      6. The total balance of "Coke ON Points" and "Coke ON Money" is called "Coke ON Wallet Balance". When you select "Coke ON Wallet" as the payment method for "Coke ON Pay" and connect the App to Smartphone Vending Machine that supports Coke ON Pay, you can use your "Coke ON Wallet Balance" to purchase Coca-Cola products. "Coke ON Points" will be used prior to "Coke ON Money" among the "Coke ON Wallet Balance".
      7. When you terminate to use the App as defined in Article 6, the use of "Coke ON Wallet" will be terminated automatically.

Article 8 - Intellectual Property Rights etc.

  1. All rights (property rights, intellectual property rights, rights of likeness, publicity rights, etc.) relating to the materials comprising the App and/or the Services (referring to lettering, photographs, videos, voice audio, etc.; hereafter, the "Content Materials") belong to the Company or third parties possessing the rights concerned, and not to Users.
  2. Users may not reproduce, distribute, reprint, transfer, publicly transmit, modify, adapt, or make any other secondary use of the Content Materials.
  3. In the event of an issue caused by violation of the provisions of this article, the User shall resolve the issue at their own cost and responsibility and shall take appropriate measures to prevent any disadvantage or damage to the Company.

Article 9 - Registered Information

Unless otherwise stipulated in these Terms and Conditions or our Privacy Policy, the Company shall use Registered Information for the following purposes.

  1. Purposes related to operating the Services and activities for marketing Company products
  2. Contacting Users regarding matters significantly affecting operation of the Services

Article 10 - Prohibited Items

When using the App/Services, Users must not take the following actions, or actions which may be suspected of such.

  1. Actions which infringe upon property and personal rights of the Company or third parties, such as all intellectual property rights, rights of likeness, and publicity rights, including but not limited to property rights and copyright
  2. Actions which cause disadvantage or damage to other Users, the Company, or third parties
  3. Actions to appropriate stamps using the App without authorization from drink purchasers at smartphone vending machines, even though the User is not a purchaser of drink(s)
  4. Repeatedly participating in campaigns by repeatedly downloading and deleting the App
  5. Actions in violation of public order and standards of decency
  6. Actions in violation of laws and ordinances etc.
  7. Actions related to the App/Services for profit without receiving approval from the Company
  8. Actions which interfere with the operation of the App/Services
  9. Actions which cause loss of trust in or discredit the App/Services
  10. Actions registering false information
  11. Transfer, sell, rent, pledge, or any other unauthorized use of the App or the Services through the User's registration information, authentication information (App ID and PIN), drink tickets, or any other information or rights related to the App or the Services
  12. Use of the App by impersonating another person using another User's device, or by any other means
  13. Actions that prevent or likely prevent the App from its normal operation, including unlawful access to the Company's systems, or that falsify program codes, falsify location information and spread any computer virus
  14. Actions that use Macro program or any function or tool enabling automatic manipulation
  15. Repeatedly entering random coupon codes or entering illegally obtained coupon codes
  16. Other actions that the Company deems inappropriate

Article 11 - Termination and/or Suspension of the App/Services

  1. The Company may for the following reasons terminate the App/Services in whole or in part.
    1. To perform regular or urgent maintenance and/or inspection of computer systems that provide the App/Services
    2. When it is impossible to administer the App/Services due to fire, power outage, natural disaster, or other emergency situation
    3. When it is impossible to administer the App/Services due to war, civil disturbance, riots, labor disputes, or other social disturbances
    4. When it is impossible to provide the Services because the computer systems that provide the App/Services fail, are maliciously accessed by a third party, or infected with a virus, etc.
    5. When it is impossible to provide the App/Services due to legal reasons etc.
    6. When the Company deems that termination and/or suspension is unavoidable for any other reason
  2. If the Company terminates operation of the App/Services due to the above reasons, the Company shall notify the User in advance through a website etc. related to the App/Services. However, this obligation will not apply in an emergency.
  3. The Company may terminate the App/Services in whole or in part by notifying the User in advance through a website related to the App/Services or through a push notification etc.

Article 12 - No Guarantee, Disclaimers and Damages

  1. The Company does not make any guarantee that contents of the App are complete, accurate, or valid and the Company does not guarantee that the App will not be interrupted, stopped, or undergo any other failure.
  2. In the event that a User has a problem with another User with regard to the use of the App, the Company assume no responsibility whatsoever, and any problems between Users shall be resolved by the User at their own expense and responsibility.
  3. The Company shall not be liable for any damage caused by the use environment of the smartphone, line, software, etc. used by Users.
  4. Even if a User is infected with a computer virus or other programs in connection with the downloading of the App due to unexpected unauthorized access or other acts, the Company shall not be liable for any damages to the user resulting from such infection.
  5. The Company shall not be liable for any disadvantages incurred by the user, such as not being able to use the Application or the Services, due to the user's failure to follow the procedures for changing the device used.
  6. If the Agreement with the User falls under the category of a consumer contract as defined in the Consumer Contract Act, the Company shall be liable for damages within the scope of normal damages and up to the amount paid for the paid service, unless the damage is caused by the Company's willful misconduct or gross negligence, if the damage is caused to the User for reasons attributable to the Company. In the case of subscription services, the Company shall be liable for damages up to the amount paid for one month.
  7. Apple Inc., Google LLC and their affiliates are not associated with any promotions through the App.
  8. The App uses GPS functions to search for nearby vending machines, even when running in the background. Please note that continuous use of GPS can significantly drain the battery.

Article 13 - Amendment to the Terms and Conditions

  1. The Company may amend the Terms and Conditions in accordance with Article 548-4 of the Civil Code of Japan, in any of the following events. The amended Terms and Conditions will apply to the Agreement.
    1. If the amendment to the Terms and Conditions conforms to the general interest of Users
    2. If the amendment to the Terms and Conditions does not run afoul of the purpose of the Agreement, and it is reasonable in light of the circumstances concerning the amendment such as the necessity of the amendment, the appropriateness of the details of the amended conditions, and the details of such provisions.
  2. If the Company decides to amend the Terms and Conditions, Company will specify the effective date of the Terms and Conditions following the amendment and will notify Users of the content and the effective date via the website, push notifications, and other methods determined by the Company.
  3. If a User does not terminate use of the App within the time period specified by the Company from the date the Company notifies the User of the changes to these Terms and Conditions in accordance with the preceding paragraph, the User shall be deemed to have accepted the changes to these Terms and Conditions. If no time period is specified, it shall be within one week from the date of the notification.

Article 14 - Consultation and Jurisdiction

  1. If doubts or problems about the App/Services arise between the User, the Company, and/or a third party, the parties shall discuss the situation in good faith to achieve a resolution.
  2. If the negotiations stated in the preceding clause do not resolve the doubts or problems, the Tokyo District Court shall be the exclusive jurisdictional court as the amount sued for dictates.

Article 15 - Governing Law and Language

  1. These Terms and Conditions shall be interpreted under Japanese law.
  2. These Terms and Conditions is made in, and construed in accordance with the Japanese language. Any translation hereof is for reference only. If any inconsistency or conflict exists or occurs between the terms of these Terms and Conditions and such translation, the Japanese language version shall prevail.
